Med Home Alert’s On-line Shopping Policy

Med Home Alert values your business, in the unlikely event that you are not satisfied with any item for any reason you should call 1-866-277-3395 or send an email to returns@medhomealert.com requesting to cancel your order/service. You will receive an RMA (Return Merchandise Authorization) number which must be referenced or written on the outside of the box. You must return the entire system in working usable condition to Med Home Alert. The system must be received by Med Home Alert on or before 30 days from the purchase date. Refunds will be issued within 30 days of the date the product is received from Med Home Alert. Buyer will remain responsible for all shipping costs from and to Med Home Alert.

 

Med Home Alert respects your right to privacy. Med Home Alert will exercise commercially reasonable efforts to ensure that your personnel information remains confidential and available only to Med Home Alert, and its employees, agents and contractors. We do not sell or share your information to others not mentioned in this statement. You will be charged the prices quoted for your products you have selected at the time you submit your order at check out. It is your responsibility to notify your bank and Med Home Alert of any changes to you billing information, or any loss theft, or unauthorized use of your credit card number. You are responsible for notifying Med Home Alert of any changes and or methods in which you pay for reoccurring services.

 

By submitting each order, you confirm and affirm that you have read, understood and agree to the Terms and Conditions of the form in which they appear at the time the order is submitted at checkout.

 

  1. It shall be Med Home Alert’s discretion to accept or reject your order. If Med Home Alert accepts your order, these Terms and Conditions and the order form collectively constitute a legal agreement between Med Home Alert and you governing your order of the Products from Med Home Alert over the on-line shopping service. 
  2. Responsibilities. Med Home Alert shall in return for your payment provide the Product which you order through the online shopping service. The product shall be delivered to the delivery address you designate. Your payment for the Product and shipping including sales tax and assessments is due upon completion of your order online. Med Home Alert will charge the payment to the credit card or bank checking account you submit to Med Home Alert and will collect the payment from your bank. You authorize Med Home Alert to make and collect such charge and any reoccurring payments for service, and agree to make payment to Med Home Alert if Med Home Alert cannot collect the charge for any reason. The total amounts you shall for the Product per each order shall be the sums of the respective prices for the items you select and submit via the order form, plus any shipping and handling charges, as reported to you as the total in the order form.   
  3. Communications. Med Home Alert shall conclusively presume that online communications received from you through your use of the online order form and registration process are accurate, complete, and authorized by you as received by Med Home Alert. You agree not to contest the validity and binding legal affect of these communications.
  4. Shopper registration. You agree to complete the initial registration process according to Med Home Alert’s requirements stated on the website, and to provide Med Home Alert with accurate, complete an updated information as required for the initial registration process, including but not limited to, your legal name, billing and delivery addresses, and telephone number. You must provide Med Home Alert with an accurate and complete credit card number, expiration date and CVS number or bank account and routing information at the time of submitting your online purchase order. You represent and warrant to Med Home Alert that your use of any credit card or bank account is authorized and legal. 
  5. Shopper Information. It is your responsibility to promptly notify your bank of any changes to your billing information or loss theft, or unauthorized use of your credit card number. You are responsible for updating your registration information and your card information as applicable.
  6. Limitations of Liability to online orders. Med Home Alert shall not be liable to you for any inception of online communications, software or hardware problems including without limitation to viruses, loss of data or compatibility conflicts, unauthorized use of your bank account or credit card information or other consequences beyond the reasonable control of Med Home Alert
  7. Disclamier of warranty. Med Home Alert’s online shopping services are provided on as “AS IS’, ‘‘AS AVAILABLE ‘basis and Med Home Alert does not provide any assurances of the availability or usability by you on the online shopping services. Med Home Alert makes no representations or warranties, whatsoever, as to the substance, or the accuracy or sufficiency thereof, of any Product or information listed on the website.
  8. Applicable law. These terms and conditions and the order form collectively constituting the sole and entire agreement regarding the online shopping services, are governed by the laws of the State of Illinois without regard to conflict of laws rules. The parties agree to jurisdiction and venue for any dispute hereunder solely in Lake County, Illinois 
  9. Changes to Terms and Conditions. Med Home Alert reserves the right to, from time to time, with or without notice to you, in Med Home Alert’s sole discretion; amend the Terms and Conditions for use and purchases regarding the online shopping services. Any amendments by Med Home Alert will be effective only as to orders you place subsequent to Med Home Alert’s revisions of these Terms and Conditions on the website to reflect the amendments. It is your responsibility to review the Terms and Conditions prior to submitting each order and Med Home Alert has no responsibility to notify you of any changes prior to effectiveness of the changes or otherwise. 
  10. Before any monitoring service can begin in connection with any online order or otherwise you must read and agree to the monitoring subscriber service agreement Terms and Conditions and provide Medical Notification Instructions to Med Home Alert. It is the responsibility of the subscriber to update Med Home Alert of any changes to the Medical Notification Instructions

Subscriber Service Agreement Terms and Conditions

  1. Agreement Parties. Subscriber understands this Service Agreement (hereafter referred to as the “Agreement) is solely by and between Med Home Alert an Illinois Corporation (hereafter referred to as “Med Home Alert”) and the subscriber (hereafter referred to as the “Subscriber”) for use of a personal emergency reporting system, and or medication dispensing service or both (hereafter referred to as the “Equipment”)
  1. Subscriber Information. Subscriber agrees to immediately update, and keep current at all times all information contained on the Medical Notification Form and to immediately report or transmit any/all changes or cancellation, in writing to Med Home Alert by Fax to 1-866-277-4191 or by email to update@medhomealert.com
  2. Installation and Testing. SUBSCRIBER ACCEPTS SOLE AND COMPLETE RESPONSIBILTY FOR SYSTEM INITIAL INSTALLATION, OPERATION, MAINTENANCE AND WEEKLEY TESTING. Weekly testing of the system is required to insure Equipment is functioning correctly. If subscriber chooses not to test the Equipment every week, subscriber agrees to release and hold harmless Med Home Alert from any/all liability should the Equipment fail to operate in the event of an emergency.
  1. Monitoring Services. Monitoring services consist of the receipt, analysis and response to signals from the Subscriber. Signals from the equipment maintained by Subscriber at the Subscriber’s premise shall be monitored by a nationwide UL listed & licensed alarm monitoring center which is not owned or operated by Med Home Alert. The monitoring company shall monitor the Subscribers Equipment by acknowledging signals from the equipment console and seeking to create two way voice communication with the subscriber at the subscribers premises through the equipment, Thereafter monitoring center may seek to contact by telephone one or more of the responders of which the Subscriber has designated on the  Medical Information Form 
  2. Event Reporting. Upon receipt of an alarm signal from the premises of Subscriber, the monitoring center will make every reasonable effort to promptly notify the police, fire department or paramedic units having jurisdiction or other persons or entities designated by Subscriber on the Medical Information Form provided by Subscriber. Subscriber agrees that the equipment may enable the emergency dispatchers to “listen in “to Subscriber’s premises and to establish two-way voice communications with occupants of the premises. Subscriber authorizes the monitoring center to utilize this feature upon receipt of an alarm to authenticate the nature of the emergency and to ascertain whether or not an emergency condition exists. THE MONITORING CENTER MAY IN ITS SOLE DISCRETION, ELECT NOT TO NOTIFY THE PARAMEDICS, POLICE OR FIRE DEPARTMENT OR OTHERS IF CENTER HAS THE SLIGHTEST REASON TO BELIEVE THAT AN EMERGENCY CONDITION MAY NOT EXIST. Subscriber acknowledges that Med Home Alert is unable under any circumstances to activate the listen-in feature from the monitoring center without having it receiving an alarm signal. The subscriber or the subscriber’s designee agrees to notify Med Home Alert of the disposition with regard to any Equipment signal within twenty-four hours (24).   
  1. Telephone Lines. Subscriber understands that a working standard telephone line and 110 VAC power is required for proper Equipment operation. Subscriber acknowledges that the signals from Subscribers equipment are transmitted over Subscriber’s regular telephone service to the monitoring center, and in the event Subscriber’s telephone service is out of order, in use unplugged, disconnected, placed on vacation or otherwise interrupted, signals from Subscriber’s Equipment will not be received by the monitoring center during any such interruption in telephone service and the interruption will not be known to the monitoring center. Subscriber shall pay all charges made by any telephone company or other utility for Installation, leasing and service charges of telephone lines and jacks connecting Subscriber’s Equipment from Med Home Alert to monitoring center. Subscriber further acknowledges and agrees that signals are transmitted over the telephone company lines which are wholly beyond the control and jurisdiction of monitoring center and are maintained and serviced by the applicable telephone company or utility. Subscriber understands that a change in telephone service may render the equipment inoperative if phone service is changed or modified subscriber agrees to verify equipment compatibility and performance.
  1. Telephone Line Requirements. SUBSCRIBER ACKNOWLEDGES, UNDERSTANDS AND ACCEPTS THAT THE EQUIPMENT WILL NOT OPERATE IF AN EXTENSION PHONE IS IN USE OR IF ANY PHONE IS “OFF THE HOOK” OR IF NO DIAL TONE IS AVAILABLE FOR ANY REASON. IF THE Subscriber has two (2) or more telephones using the same number, Subscriber may need to install either a dedicated telephone line or a RJ31X jack to insure proper Equipment operation. The RJ31 jack allows the Equipment to send a signal over the phone lines even though any phone is in use or off the hook. Any system Equipment without the RJ31X cannot communicate with the monitoring center under those specific circumstances. Please note that the RJ31X jack is an optional item and that the Equipment will communicate without it providing the phone is not in use or off the hook. This optional jack can be ordered from your phone Company or utility provider.
  1. Equipment. The Terms and Conditions of this agreement apply to any Equipment that may be substituted for the original Equipment. Loss Damage or Repair of Equipment. Subscriber assumes full responsibility for loss of or damage to Med Home Alert’s Equipment in Subscribers possession. Subscriber agrees to pay Med Home Alert the fair market value of such Equipment which is lost and the actual cost of repairs to damaged Equipment. Subscriber agrees It is the sole responsibility of Subscriber to test the Equipment to ensure proper functioning of all Equipment. In the event that Subscriber is unable to perform a successful System test with the Equipment. Subscriber agrees to immediately notify Med Home Alert in writing if any Equipment is in need of repair and or malfunctions. Med Home Alert will ship replacement Equipment within 48hrs of written notice exclusive of weekend and holidays at the  Subscribers expense
  1. Equipment Title. Title to equipment shall be the property of Med Home Alert and Subscriber shall have no interest there in.
  1. NO WARRANTY OR REPRESENTATION. MED HOME ALERT DOES NOT REPRESENT OR WARRANT THAT THE EQUIPMENT MAY NOT BE COMPROMISED OR CIRCUMVENTED OR THAT THE EQUIPMENT WILL IN ALL CASES PROVIDE THE PROTECTION FOR WHICH IT IS INTENDED. MED HOME ALERT EXPRESSLEY DISCLAIMS ANY IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND THE FACT OR PROMISE MADE BY MED HOME ALERT OR ITS AGENTS, SERVANTS OR EMPLOYEES SHALL NOT BE DEEMED TO CREATE AN EXPRESS WARRANTY UNLESS INCLUDED IN THE AGREEMNT IN WRITING.
  2. SUBSCRIBER AGREES AND UNDERSTANDS : THAT MED HOME ALERT IS NOT AN INSURER AND THAT INSURANCE COVERING PERSONAL INJURY, INCLUDING DEATH, AND REAL OR PERSONAL PROPERTY LOSS OR DAMAGE IN, ABOUT OR TO THE PREMISES SHALL BE OBTAINED BY THE SUBSCRIBER: THAT MED HOME ALERT MAKES NO GUARANTEE, REPRESENTATION OR WARRANTY INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANT-ABILITY OR FITNESS FOR PURPOSE; THAT THE EQUIPMENT AND SERVICES ARE DESIGNED TO REDUCE, BUT NOT ELIMINATE, CERTAIN RISKS OF LOSS AND THAT THE AMOUNTS BEING CHARGED BY MED HOME ALERT ARE NOT SUFFICENT TO WARRANT OR GUARANTEE THAT EITHER NO LOSS OR DAMAGE WILL OCCUR OR INCREASED LOSS OR DAMAGE WILL NOT OCCUR; THAT MED HOME ALERT IS NOT LIABLE FOR ANY LOSS OR DAMAGE WHICH MAY OCCUR PRIOR TO, CONTEMPARANEOUS WITH OR SUBSEQUENT TO THE EXECUTION OF THIS AGREEMENT EVEN IF DUE TO THE ACTIVE OR PASSIVE SOLE, JOINT OR SEVERAL NEGLIGENCE OF MED HOME ALERT OR ITS AGENTS, SERVANTS, EMPLOYEES, SUPPLIERS OR SUBCONTRACTORS, OR TO THE IMPROPER PERFORMANCE OF AND/OR FAILURE TO PERFORM OF THE EQUIPMENT, OR BREACH OF CONTRACT, EXPRESS 0R IMPLIED, OR BREACH OF WARRANTY, EXPRESS OR IMPLIED, OR BY LOSS OR DAMAGE TO FACILITIES NECESSARY TO OPERATE THE SYSTEM OR ANY CENTRAL STATION; THAT SHOULD THERE ARISE ANY LIABILITY ON THE PART OF MED HOME ALERT FOR PERSONAL INJURY, INCLUDING DEATH AND OR PROPERTY DAMAGE, REAL OR PERSONAL WHICH IS IN CONNENTION WITH, ARISES OUT OF OR FROM, OR RESULTS FROM THE REMOTE PROGRAMMING OR MONITORING OF ANY EQUIPMENT OR SYSTEM, AND/OR THE DISPATCH OF INDIVIDUALS TO THE PREMISES, AND/OR THE FAILURE OR FAULTY OPERATIONOF THE SYSTEM, EQUIPMENT OR CENTRAL STATION FACILITIES, AND/OR THE ACTIVE OR PASSIVE SOLE, JOINT OR SEVERAL NEGLIGENCE  ( INCLUDING GROSS NEGLIGENCE ) OF MED HOME ALERT AND OR ITS AGENTS, SERVANTS, EMPLOYEES, SUPPLIERS, OR SUBCONTRACTORS INCLUDING WITHOUT LIMITATION, ACTS, ERRORS OR OMMISIONS WHICH OCCUR PRIOR TO, CONTEMPORANEOUSLY WITH OR SUBSEQUENT TO THE EXECUTION OF THIS AGREEMENT, AND/OR ANY CLAIM(S) BROUGHT IN PRODUCT OR STRICT LIABILITY, AND/ORBREACH OF WARRANTY, EXPRESS OR IMPLIED, AND/OR BREACH OF CONTRACT EXPRESS OR IMPLIED, AND/OR ANY CLAIM FOR DISTRIBUTION OR INDEMNIFICATION, WHETHER IN CONTRACT, TORT OR EQUITY, INCLUDING WITHOUT LIMITATION, ANY GENERAL, DIRECT, SPECIAL INCIDENTAL, EXEMPLARY, PUNITIVE AND/OR CONSEQUENTAL DAMAGES, IRRESPECTIVE OF CAUSE, SUCH LIABILITY SHALL BE LIMITED TO THE MAXIMUM SUM OF $250.00;(TWO HUNDERED AND FIFTY DOLLARS) AND THIS LIABILITY SHALL BE EXCLUSIVE. IN THE EVENT THAT THE SUBSCRIBER WISHES TO INCREASE THE MAXIMUM AMOUNT OF SUCH LIMITED LIABILITY, SUBSCRIBER MAY, AS A MATTER OR RIGHT, OBTAIN FROM MED HOME ALERT A HIGHER LIMIT BY PAYING AN ADDITIONAL AMOUNT FOR THE INCREASE IN SUCH LIMIT OF LIABILITY, BUT THIS HIGHER LIMITATION SHALL IN NO WAY BE INTERPRETED TO HOLD MED HOME ALERT AS AN INSURER.   
  1. False Alarms. In the event of an excessive number of false alarms caused by Subscriber’s carelessness, malicious action or accidental use of the Equipment, Med Home Alert may at its sole discretion, deem same to be a material breach of contract on the part of Subscriber and at its option, in addition to all other legal remedies available to Med Home Alert be, excused from further performance, upon the giving of ten (10) days written notice to Subscriber. Med Home Alert’s excuse from performance shall not affect its right to recover damages from Subscriber. In the event a fine, penalty or fee is assessed against Med Home Alert by any governmental or municipal agency as a result of any alarm originating from Subscriber’s premises. Subscriber agrees to forthwith reimburse Med Home Alert for same.
  1. Local Permits. Subscriber is solely and completely responsible for obtaining and maintaining and shall apply for, retain and pay for all licenses, permits, or other charges imposed by any governmental agency necessary for the installation and use of the system Equipment. Subscriber is responsible for investigating specific permits required by local municipality, law enforcement agency or other appropriate jurisdictional body. Subscriber understands Med Home Alert is a retailer or user installed emergency reporting and medication monitoring systems and is not a state-licensed alarm dealer or installer.
  1. Suspension or cancellation. This Agreement may be suspended or cancelled without notice at the option of Med Home Alert if Med Home Alert’s contracted monitoring facilities or Subscriber’s premises or equipment are destroyed by fire or other catastrophe, or so substantially damaged that it is impractical to continue service or in the event Med Home Alert is unable to render service as a result of any action by any governmental or regulatory authority.
  1. Subscriber’s duties. Subscriber shall carefully use and instruct all members of his or her household proper use of the Equipment. Subscriber if not testing the system and notifying the monitoring center of the same, shall use the system only to report incidents or occurrences that impose an immediate and present danger of burglary, robbery, or other circumstances that endanger the life or personal safety of Subscriber or others in Subscriber’s home.
  1. Agreement term. The initial term of this agreement is for a minimum 90 day period and is effective when the monitoring service is first activated or the equipment is received by the subscriber. The contract will automatically renew unless either party gives written notice of its intent to cancel. If service is cancelled within the first 90 days or the system is never activated for any reason subscriber agrees to pay a $50.00 restocking fee. In addition subscribers account will continue to be billed at the monthly rate the subscriber subscribed for until the equipment is returned in good working order. Failure to return all equipment in satisfactory condition will result in a charge of 250.00 per system. Upon cancellation subscriber must then return any leased equipment at its own expense to a place designated by Med Home Alert and make full payment of services. Med Home Alert reserves the right to charge interest, collection costs including attorneys fees for outstanding monitoring fees and equipment not returned. Med Home Alert is authorized to charge any of the listed subscriber’s credit cards for delinquent services and or equipment if service has been disconnected and equipment not returned.
  2. Audio Listen in and Forcible Entry: The Medical Alert Equipment includes two Way voice and is meant to be heard under optimal conditions throughout most of The premises. In the event that the two way audio is not clear, or the central station  Does not hear the audio, Subscriber authorizes Med Home Alert and the Monitoring center to follow emergency response procedures. The monitoring center will notify 911 first, unless otherwise told in writing. Subscriber authorizes Med Home Alert and the monitoring center in its sole
    discretion to authorize forcible entry to gain access to Subscriber’s premises in the event the Equipment emits a signal to the monitoring center and Subscriber cannot be heard through the units microphone nor does the Subscriber answer the telephone. Subscriber does hereby release Med Home Alert and the monitoring center from any and all liability whatsoever as a result of forcible entry.
  1. Physical Response. The Subscriber is advised that certain areas of the country have in existence requirements that when an alarm monitoring service reports a medical alarm to a responding agency, that it must also report such alarm to an entity available twenty-four hours each day which is contractually obligated to respond to the emergency within one hour or within another designated time.
  2. Invalid Provisions. In the event that any of the terms or provisions of this Agreement shall be invalid or inoperative, all of the other terms thereof shall remain in full force and affect.
  1. Subscriber Approval and Acceptance. Activation of the Equipment by Subscriber confirms that Subscriber or authorized legal representative, has read understands and accepts the Med Home Alert Service Agreement in its entirety without exception or exclusion. The undersigned represents and warrants that he/she is the persons who will be using the Equipment, or legal representative of the subscriber, is of legal age to enter this agreement and agrees to be bound by all the Terms and Conditions of this Service Agreement. Subscriber acknowledges receipt of a copy of this agreement. Subscriber hereby authorizes Med Home Alert or its assignee “Monitoring Services” to initiate ongoing electronic debits from Subscribers credit card or bank account for all amounts due under this agreement in accordance to payment cycle selected. Subscriber may cancel this agreement by written notice and return of Med Home Alerts equipment.
  2. Governing Law: This Agreement shall be governed by the Laws of the State of  Illinois.
